As of 2025, the Expanded Maternity Leave Law (Republic Act No. 11210) remains in effect, granting eligible female workers:

  • 105 days of fully paid maternity leave for live childbirth, applicable to both normal and cesarean deliveries.

  • An additional 15 days for solo parents, totaling 120 days of paid leave.

  • 60 days of paid leave for miscarriage or emergency termination of pregnancy.

  • An optional 30 days of unpaid leave upon request.

  • SSS Contribution Increase: Starting January 1, 2025, the Social Security System (SSS) increased the contribution rate from 14% to 15%, with employers contributing 10% and employees 5%. Additionally, the minimum Monthly Salary Credit (MSC) rose to ₱5,000, and the maximum MSC to ₱35,000.

To illustrate how maternity benefits are computed, consider the following scenario:

Assumptions:

  • Monthly Salary Credit (MSC): ₱20,000

  • Type of Delivery: Normal childbirth

  • Eligibility: The employee has paid at least three monthly SSS contributions in the 12 months preceding the semester of childbirth.

Computation Steps:

  1. Determine the Average Daily Salary Credit (ADSC):

    • ADSC = Total of the six highest MSCs in the 12-month period ÷ 180

    • ADSC = (₱20,000 × 6) ÷ 180 = ₱666.67

  2. Calculate the Total Maternity Benefit:

    • For normal delivery: ₱666.67 × 105 days = ₱70,000.35

Note: Employers are responsible for paying the salary differential, which is the difference between the employee’s full salary and the SSS maternity benefit.
